Abstract
This article aims to understand and understand, in addition to investigating how the State may be contributing to the protection of minors, regarding the problem of parental alienation. Before solving this problem, it is necessary to first analyze its origin. According to recent studies, the most appropriate solution is shared custody, a topic that will also be discussed here. Shared custody was enshrined in Brazil through Law 13.058/14, which provides for the rights and duties of parents, with regard to the creation of minors arising from their relationship. As a rule, shared custody emerged in Brazil in 2008, as an option between parents, but only after the aforementioned law came into effect, which became mandatory in Brazilian territory. The references used in this essay were bibliographical, with reference to specific books and articles, and the methodology used was deductive.
