Abstract
Freedom of expression is a topic that demands more careful and recurrent treatment by society today, mainly due to the fact that technologies provide a wider range of freedom of expression for users. To this end, the Civil Rights Framework and the General Law of Data Protection came about after a long discussion and the search for the regulation of the use within the internet, the difference being that one is focused on the freedom of expression as a whole and the other is focused on the private data of individuals separately. The present work is based on a bibliographical research, carried out in books, magazines, periodicals, articles and dry legislation, related to the General Law of Data Protection and to the Civil Landmark of the Internet, seeking to bring in a clear and objective way the importance of the Fundamental Right, which is the Freedom of Speech, and at the same time, to show the flaws in the legislation that incurs in the spreading of the known "Fake News". Showing the importance of legislation in the virtual environment and the need for knowledge about the false news linked.
